This agreement outlines the responsibilities of the customer for a clear understanding of the services provided and acceptable usage. This establishes the framework for the use of the hosting services, detailing the obligations for Epcom Hosting Services and the client. It is essential to review the terms carefully, as they govern everything from acceptable use to content policies.
Any breach of these provisions can lead to Epcom Hosting Services exercising their right to change or close the client account, often without prior written notice, depending on the severity of the violation.
Payment and Refunds
Billing and Invoicing
Invoices are generated at the start of each billing cycle (monthly, quarterly, annually, or other interval selected at purchase). By signing up for services, clients authorize Epcom Hosting Services to charge the payment method on file for all recurring fees, taxes, and any outstanding balances.
If a payment method fails, Epcom Hosting Services will attempt reauthorization and notify the client; repeated failures may result in suspension or cancellation of services. Clients must make sure that their billing information is current and agree to reimburse Epcom Hosting Services for any collection costs, legal fees, or other expenses incurred in recovering overdue amounts.

Refund Policy and Money-Back Guarantees
Refund eligibility is typically limited to new accounts or specific promotional plans and may exclude setup fees, domain registration fees, third-party software licenses, and certain add-ons. Refunds will be processed to the original payment method within a stated timeframe (e.g., 7–30 business days) after Epcom Hosting Services approves the refund.
Partial refunds (pro rata) may apply where a client cancels mid-billing cycle, subject to the plan terms and any minimum commitment period. Certain charges are non-refundable, including but not limited to: fees for domain registrations and renewals, SSL certificate purchases, usage-based overage charges, and payments for third-party products or services.

Permitted Uses of Web Hosting Services
Under these terms, Epcom Hosting Services permits publishing websites, blogs, digital agencies, portfolios, and PCI-compliant e-commerce stores. Resource usage should match the plan purchased and be consistent with the functional purpose of the hosting account, and hosted content must not facilitate illegal activities, infringe intellectual property, or expose the platform to undue risk or abuse.
Clients must manage their hosted sites and related services responsibly, employing appropriate security practices, keeping software and plugins up to date, and managing user data in line with legal privacy obligations. Commercial offerings, downloads, and API endpoints should be presented truthfully and follow consumer protection requirements; any automated processes or high-volume transactions should be coordinated with Epcom Hosting Services.
Permitted Uses of VPS Hosting Services
Under these terms, Epcom Hosting Services permits deploying and running public-facing websites, content management systems, e-commerce platforms, and web applications. Permitted uses include but are not limited to hosting databases, running development and staging environments, provided that shared resource allocations are respected. Secure remote access for administration, automated backups, disaster recovery configurations, and routine maintenance tasks is acceptable when performed in ways that preserve platform stability and data integrity.
Permitted Uses of Dedicated Server Hosting Services
Under these terms, Epcom Hosting Services grants the client exclusive control of a physical server instance, enabling high performance, extensive customization, and support for large-scale websites and complex applications. Permitted uses include but are not limited to deploying multi-tier architectures, implementing and managing security configurations, and exercising administrative control over the hosted environment.

Permitted Uses of Hybrid Cloud Hosting Services
Under these terms, Epcom Hosting Services clients are permitted to deploy applications, host sensitive or regulated data on private cloud segments, and leverage public cloud capacity for non-sensitive, burstable workloads or content distribution. Permitted uses include but are not limited to web hosting, data analytics, continuous integration/continuous deployment (CI/CD) pipelines, development and testing environments, disaster recovery, and backup operations, provided such uses comply with applicable laws and regulatory requirements.
Prohibited Activities and Content
- Hosting, distribution, or linking to illegal materials, including items that facilitate criminal activity or violate export controls.
- Uploading, sharing, or making available copyrighted works, trademarks, or other intellectual property without the necessary rights, licenses, or permissions from the rights holder.
- Creation, distribution, or facilitation of malicious software, viruses, worms, trojans, spyware, ransomware, rootkits, or any code intended to compromise, degrade, or hijack systems or data integrity.
- Content that is libelous, defamatory, obscene, hate speech, or threats of violence; any material that promotes or facilitates sexual exploitation or abuse.
- Operating phishing, pharming, spoofing, or social engineering campaigns designed to obtain credentials, financial information, or other sensitive data from third parties.
- Launching, facilitating, or participating in distributed denial-of-service (DDoS) attacks, flooding, port scanning, probing, or other activities intended to impair or degrade network or system availability for other customers or third parties.
- Unauthorized access, password cracking, brute-force attacks, or any attempt to penetrate, probe, or bypass security measures of our systems or those of third parties.
- Running unlicensed or unauthorized cryptocurrency mining, botnets, or other background processes that consume disproportionate CPU, memory, disk I/O, or network bandwidth and adversely affect shared environments.
- Hosting, distributing, or linking to illegal file-sharing, piracy, or circumvention tools that enable the bypass of digital rights management or subscription services.
- Providing illegal or unlicensed financial services, illegal gambling, or marketplaces that facilitate the sale of illegal goods, stolen data, malware, counterfeit products, or unregulated substances.
- Operating mail servers or sending bulk email without complying with applicable anti-spam laws; engaging in high-volume unsolicited messaging, harvesting of addresses, or use of open relays.
- Using the service to store or process sensitive personal data (such as payment card data, health records, or government identifiers) in violation of applicable privacy, data protection, or industry standards unless appropriate security, encryption, and compliance arrangements are in place and approved by Epcom Hosting Services.
- Hosting content or services that violate sanctions, trade restrictions, or embargoes imposed by applicable law or government authorities.
- Any activity that knowingly results in excessive or sustained consumption of resources beyond the customer’s plan limits (CPU, memory, disk usage, IOPS, database connections, network egress) or that interferes with the normal function of the hosting environment.
Violations of these prohibitions may result in immediate action by Epcom Hosting Services, including suspension, throttling, removal of specific content, permanent deletion of services, account, and data, without prior notice where necessary to prevent harm. Epcom Hosting Services reserves the right to:
- Look into alleged breaches of these terms and preserve logs, metadata, and copies of pertinent content for investigation, security, and compliance purposes.
- Provide notice to other customers, third-party providers, or law enforcement as required by applicable law or as reasonably necessary to protect other customers and the network.
- Bill the account holder for expenses incurred in connection with remediation or restoration of service following a security incident or misuse.
Customers are responsible for all activity originating from their accounts and must indemnify and hold Epcom Hosting Services harmless for liabilities emerging from prohibited uses. If a customer believes a suspension or removal was made in error, they can file an appeal in writing; however, final decisions about safety rest with Epcom Hosting Services. Compliance with these content rules is a condition of continued access to our hosting services, website, and solutions.
User Responsibilities and Obligations
Clients are required to maintain the confidentiality and security of their account credentials, take commercially reasonable measures to prevent unauthorized access, and promptly notify Epcom Hosting Services upon request if they suspect any security breach. Use of the services for illegal activity, infringement of third-party rights, or in violation of applicable law is prohibited and may constitute a breach.
Clients remain responsible for the content of any domain names and websites hosted by Epcom Hosting Services. Even where automated backup services are provided, clients should regularly perform and retain backups, as the services are provided “as is” and Epcom Hosting Services does not warrant error-free backup or restoration.
Clients must promptly pay any invoice for services, including renewal of services where applicable. Failure to pay may result in suspension or cancellation of the services at any time and constitutes a material breach, allowing Epcom Hosting Services to terminate this agreement. Any disputes about invoices should be raised in writing with Epcom Hosting Services.
Customers shall provide accurate contact information and cooperate with Epcom Hosting Services and any third-party service providers engaged to deliver specific services. Clients shall provide written consent where required and respond to written notice or other communications upon request. The client agrees to use commercially reasonable efforts to assist in the investigation and remediation of security incidents and to comply with any legal process or competent jurisdiction orders applicable to the provision of services.
If a client’s conduct creates a risk to the network, other customers, or violates these terms of service for this website and other solutions, Epcom Hosting Services reserves the right to suspend, restrict, or cancel the services provided to the client, without liability, and to take any other actions reasonably necessary to mitigate harm.
All client websites, applications, and environments that process, store, or transmit payment card data are required to be fully compliant with the Payment Card Industry Data Security Standard (PCI DSS). PCI compliance is critical to protect cardholder information, prevent fraudulent activity, and preserve customer trust and business continuity. Clients have the option to use PCI-compliant payment processors like Authorize.NET or Stripe on their websites. Clients who develop, implement, and maintain their own payment processor must provide proof of compliance, including the PCI Attestation of Compliance (AOC).
Disclaimer
Epcom Hosting Services will use commercially reasonable efforts to deliver hosting services, website management, and related solutions; however, Epcom Hosting Services does not warrant that the services will be uninterrupted, error‑free, or free of harmful components. Epcom Hosting Services disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non‑infringement, to the fullest extent permitted by law.
Planned maintenance, emergency maintenance, and other maintenance activities may require temporary suspension or degradation of services. Epcom Hosting Services will use reasonable efforts to provide advance notice of planned maintenance when practicable, but does not guarantee notice timelines. Epcom Hosting Services is not liable for interruptions, delays, data loss, or other issues arising from scheduled or unscheduled maintenance.
While Epcom Hosting Services implements commercially reasonable security and backup practices, the customer is responsible for maintaining independent copies of all content, data, and configurations. Epcom Hosting Services does not guarantee full data recovery in every circumstance. Customers must follow Epcom Hosting Services’ published backup and restore procedures and promptly report any suspected data loss or corruption.
Force majeure events—such as acts of God, natural disasters, war, terrorism, strikes, pandemics, governmental actions, or other events beyond Epcom Hosting Services’s reasonable control—may delay or prevent service delivery. In such events, Epcom Hosting Services’ obligations will be suspended to the extent affected, and Epcom Hosting Services will not be liable for damages caused by such delays.
To the extent permitted by applicable law, Epcom Hosting Services’s aggregate liability emerging from or related to the services, whether in contract, tort, or otherwise, is limited as outlined in Epcom Hosting Services’s liability and indemnification provisions. These disclaimers form an integral part of the terms of service for hosting services, websites, and solutions, and apply to all customers and users of the services.
Dispute Resolution
Any dispute arising out of or relating to these terms, the services provided, shall first be raised in writing and presented to designated representatives of the parties for good-faith negotiation. This informal resolution process is a prerequisite to pursuing formal dispute resolution except where immediate injunctive or equitable relief is sought.
If the parties are unable to resolve the dispute through informal negotiation, the matter will be submitted to final and binding arbitration under the rules of the American Arbitration Association or a successor organization agreed upon by the parties. The arbitration will be conducted by a single neutral arbitrator with experience in technology and hosting disputes, and will take place in New York City, New York. The arbitrator shall apply the substantive laws of the State of New York, and the award may be entered and enforced in any court having jurisdiction.
Notwithstanding the agreement to arbitrate, either party may seek provisional remedies or emergency relief from a court of competent jurisdiction in New York to address immediate harm that cannot be remedied by arbitration in time. Small claims actions may be pursued by either party in small claims court if the matter falls within that court’s jurisdictional limits. Each party will bear its own attorneys’ fees and costs unless the arbitrator or court determines that shifting of fees is appropriate under New York law. The parties acknowledge that these dispute resolution provisions apply to all claims arising out of the terms of service for hosting services website and solutions, including statutory, contract, tort, and equitable claims, to the fullest extent permitted by law.
Changes to these Terms
We may update or revise these terms of service from time to time to reflect changes in law, technology, business practices, or the services and solutions we offer. Changes will take effect on the date stated at the bottom of this page. Continued use of our hosting services and solutions, after changes are posted, will be considered acceptance of the updated terms for your account and any services you use.
